Changes to the practice of accepting and retaining Grants of Probate

The practice of accepting and retaining Grants of Probate and Letters of Administration has been changed. Grants of Probate and Letters of Administration should only be submitted with an application lodged for registration and not lodged in advance of same.  TÉ does not own or create probate records. Pre-registration lodgement of probate records is not a requirement for registration. It is not a function within our statutory remit to store originals and/or provide copies on request to interested parties.

TÉ Registration will accept lodgement of original Grants of Probate/Letters of Administration, or official copies such as Probate office  copies or Court Office copies lodged with an application. The Probate Office issues Grants of Probate and Letters of Administration and it can provide such official copies on request.

Records prior to 1992 are held by the National Archives of Ireland who can also provide copies on request.

Practitioners should note that it is only in certain limited circumstances that solicitor certified copies or plain copies may be acceptable e.g. if it relates to several steps back on title in a First Registration case.

This decision has been made by the Registration Senior Management Team (RSMT) and is now in effect.
